Les présentes conditions générales d'utilisation (dites « CGU ») ont pour objet l'encadrement juridique des modalités de mise à disposition de l'application et des services de «ExplorFrance» et de définir les conditions d’accès et d’utilisation des services par « l'Utilisateur ». Les présentes CGU sont accessibles sur dans l'application à la rubrique «à propos» puis «CGU».
Article 1 : Les mentions légales

ARTICLE 2 : Accès à l'application
L\'application permet à l\'Utilisateur un accès aux services suivants : créer un joueur, jouer au jeux en affichant dans un navigateur webview une page de site libre externe proposant l'affichage de carte géographique de et proposer une réponse correspondant à l\'endroit coordonnées géographiques. Il participe à un classement des points des joueurs. Le nom choisi dans le premier ecran est affiché dans le leaderboard. Tous les frais supportés par l'Utilisateur pour accéder au service (matériel informatique, logiciels, connexion Internet, etc.) sont à sa charge.

Malgré des mises à jour régulières, l'application ExplorFrance ou son développeur ne peut être tenu responsable de la modification des dispositions administratives et juridiques survenant après la publication. De même, l'application ou son développeur ne peut être tenue responsable de l’utilisation et de l’interprétation de l’information contenue dans cette application. L'application ExplorFrance ou son développeur ne peut être tenu pour responsable d’éventuels virus qui pourraient infecter le télphone ou l'ordinateur ou tout matériel informatique de l'Utilisateur, suite à une utilisation, à l’accès, ou au téléchargement provenant de cette application. La responsabilité de l'application ou du développeur ne peut être engagée en cas de force majeure ou du fait imprévisible et insurmontable d'un tiers.
ARTICLE 6 : Liens hypertextes
Des liens hypertextes peuvent être présents sur l'application. L’Utilisateur est informé qu’en cliquant sur ces liens, il sortira de l'application. L'application ou son développeur n’a pas de contrôle sur les pages web/ les applications tierces sur lesquelles aboutissent ces liens et ne saurait, en aucun cas, être responsable de leur contenu.
ARTICLE 7 : Cookies
L’Utilisateur est informé que lors de l'utilisation de l'application, un cookie peut s’installer automatiquement. L'application permet aux membres de publier/créer les contenus suivants :
- Envoi de photo par email à l'email indiqué par l'utilisateur
- Accès au serveur d'envoi email SMTP renseigné par l'utilisation (adresse et port, login, mot de passe).
Dans ses publications et ses créations, l'utilisation s’engage à respecter les règles de la Netiquette (règles de bonne conduite de l’internet) et les règles de droit en vigueur. Tout recours en justice engagé par un tiers lésé contre le site sera pris en charge par l'Utilisateur. Le contenu de l'Utilisateur peut être à tout moment et pour n'importe quelle raison supprimé ou modifié par l'application, sans préavis.

You should be aware that there are certain things that ExplorFrance will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but ExplorFrance cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges.
